Terms of Service

The agreement between you and the operator of Moymo: what you can expect from us, what we expect from you, and what happens when something goes wrong.

1. Who we are

Moymo (moymo.net) is a community service for rating, reviewing and organising video games. These Terms apply to everyone who uses Moymo - visitors, members and studios. The Community guidelines are part of them. The Privacy notice is not part of the contract: it explains how we handle personal data, and you do not have to agree to it.

Moymo is free. We do not sell anything to members, take no payments and do not sell your data.

2. Your account

You create an account by accepting these Terms. The contract is concluded when the account is created, in the language you used, Czech or English.

  • You must be at least 15 years old, and you confirm that you are when you sign up.
  • One person, one account. Studio teams are set up in the studio programme, not with shared accounts.
  • Give an e-mail address that works and keep your password to yourself. You are responsible for what happens under your account; tell us straight away if you think someone else has access to it.
  • Your username and display name must not imitate another person, Moymo, a studio or a brand, and must follow the guidelines.
  • If you sign up with Google or Discord, you accept these Terms on the screen that follows your first sign-in.
  • You can delete your account at any time in your settings, which ends the contract.

3. Your content and the licence you give us

What you create and upload stays yours: reviews, ratings, lists, profile texts, avatars, backgrounds, videos, cursors, fonts, profile music, studio logos and texts, messages.

So that we can run Moymo, you give us a non-exclusive, worldwide, royalty-free licence to your content, for as long as the rights in it last, to: store and reproduce it; make it available to the public on Moymo, on member pages under moymo.net and on members' own connected domains, and in link previews and search engines; and adapt it technically - resize, crop, compress, convert and re-encode it, and make thumbnails and still images. Our hosting providers may do the same on our behalf, only for these purposes. The licence covers only operating and presenting Moymo; we will not sell your content or use it in advertising.

The licence ends when you delete the content or your account. It continues only for copies in backups until they expire (30 days); for corrections and suggestions you made that were adopted into the game catalogue; for profile templates you published that other members had already used; for messages you sent in a conversation with someone else; and for copies we must keep as evidence by law, for example about a moderation decision.

Where your content is shown, it is shown with your username.

4. What you upload must be yours to share

By uploading or publishing anything you confirm that you created it or hold all the rights needed to publish it online on Moymo, and that publishing it does not infringe anyone's rights - copyright, trademarks, privacy or personality rights.

  • Music: upload only music you made yourself or have a licence to publish online. A song you bought or stream is not licensed for that. When you upload a profile track you confirm this separately.
  • Images, video and fonts: do not upload art, screenshots, photos or typefaces you have no right to share. Photos of other people need their consent.
  • Texts: do not paste reviews or descriptions written by someone else.

If someone makes a claim against us because of content you uploaded in breach of this section, you are responsible, under the law, for the damage your breach caused.

5. Rules

Follow the Community guidelines and the law. In particular, do not publish illegal content, harass anyone, infringe other people's rights, or use Moymo to spread spam or malware.

  • Do not create accounts in bulk or for other people, trade accounts, or manipulate ratings, invitations or giveaways.
  • Do not automate Moymo without asking first. Reading public pages with reasonable scripts is fine; writing with them is not.
  • Do not try to break into Moymo or disrupt it. If you find a security problem, report it as described on the Legal information page, and do not access other people's data.
  • Do not link a game or social account that is not yours.

6. How we moderate content

We host what members and studios publish, and we act on content that is illegal or breaks these Terms. We learn about it from notices, from the report button on reviews, and from our own review of reported or prominent content.

Decisions are made by a person. We do not use automated tools to remove or restrict content; automated systems only enforce technical limits such as rate limits and permitted file types.

Depending on how serious a breach is, we can:

  • remove content or disable access to it;
  • restrict its visibility, for example take it out of public lists or off the home page;
  • switch off a feature for your account or your studio, such as a custom domain or the studio programme, for a period or for good;
  • suspend your account for a stated period or until a stated condition is met;
  • suspend your account with no end date, for serious or repeated breaches; the account is kept so that an appeal can still undo the decision.

We decide proportionately and with regard to everyone's rights, including freedom of expression. Child sexual abuse material is removed at once and reported to the police.

Whenever we act against your content or account, you receive a statement of reasons (Digital Services Act Art. 17): what we did, whether it was based on the law or on these Terms and which provision, the facts, whether anything automated was involved, and how to challenge it. It arrives as a notification and by e-mail, and every decision about you is listed on My moderation decisions.

If someone frequently sends notices that are clearly unfounded, we may, after a warning, stop processing their notices for a reasonable period.

7. Reporting illegal content

Anyone can report content they consider illegal or against these Terms with the notice form, without an account. Say exactly where it is, why you think it is illegal or against the rules, and give your name and e-mail address - except when reporting child sexual abuse material, where you may stay anonymous - and confirm that you are acting in good faith.

We confirm receipt by e-mail, decide without undue delay, and tell you the outcome and how to challenge it. When we suspect a crime that threatens someone's life or safety, we inform the police. Rights holders use the same form, under the copyright category.

8. Appeals and disputes about moderation

If you disagree with a decision about your content or account, or with how we handled your notice, you can appeal within six months on My moderation decisions, or through the link in the e-mail if you cannot sign in. A person reviews the appeal and answers with reasons. If the decision was wrong it is reversed and the content or account is restored.

You can also turn to an out-of-court dispute settlement body certified under Article 21 of the Digital Services Act; the European Commission publishes the list. And you can always go to court.

9. How Moymo orders games

Moymo decides the order of games in several places. These are the main parameters of its recommender systems (Digital Services Act Art. 27). Nobody can pay for a better position, and studio games are treated like all others.

  • Moymo Index - a score from 0 to 100 for each game: a weighted average of ratings on Steam, on IGDB (players and critics) and on Moymo, where each source counts by the number of people behind it (up to 1,000), plus the weight of 20 votes for a typical game scored 75, so that a handful of ratings cannot make a game look perfect. A score is published only once it rests on at least 10 opinions. It orders the best-of lists, the leaderboards and quality-based sorting.
  • Similarity between games - two games are close when they share specific Steam user tags, IGDB keywords and themes, genres and developer, and when members play and like them together (from members' ratings, library shelves and playtime, counted in aggregate; members who switched off personalised recommendations are left out). Games from the same series are not listed as each other's neighbours. It drives ‘similar games’ on game pages, ‘Because you liked’ rails and Discovery.
  • Home page - the carousel shows games pinned by staff first, then for signed-in members up to two picks from their taste, then the best-rated games with artwork. Trending is computed from the ratings members made public in recent days, one vote per member per game. Rails may move a game up to six places when it is close to your taste.
  • Personal recommendations and ‘For you’ sorting - built from your ratings, library shelves, ‘not interested’ marks and playtime. Games close to several games you liked come first, games close to ones you turned down are pushed down, and games you already know are left out. Between equally close games, the one with better scores from other sources, such as Steam and IGDB, comes first; each further pick resembling the same favourite counts a little less, so that one game cannot fill the list; and near-ties change places from day to day.
  • Discovery - starts from the games you pick, then from your history; you choose the platform and play style.
  • Search and the catalogue - ordered by how well a title matches, or by the sorting you choose.

You can switch off personalised recommendations at any time in your privacy settings. You then see the same non-personalised order as visitors who are not signed in - staff picks, trending and the Moymo Index - and your taste profile is deleted. Catalogue sorting is always yours to choose.

10. Moymo+ and Moymo MAX

  • Moymo+ and Moymo MAX are free tiers that unlock extra profile features. They cannot be bought, sold or transferred.
  • Moymo+ is yours while your Discord account is linked to Moymo and you are a member of the Moymo Discord server. When either stops being true, Moymo+ granted this way ends automatically.
  • Moymo MAX is granted when you meet the Moymo+ conditions and three people you invited qualify (see Invitations). A tier can also be earned by reaching certain badge levels.
  • A tier earned through invitations or badges is ‘for life’: it has no expiry date and is not withdrawn when the Discord condition lapses. It lasts as long as your account exists and Moymo offers that tier. ‘For life’ does not mean every feature stays exactly as it is: we may change, replace or retire the features of a tier, and we will tell you in advance of significant changes.
  • Staff may grant a tier for a stated period; it then ends on that date.
  • We may withdraw a tier obtained by breaking these Terms, for example through fake accounts, and every tier ends when the account is closed.

11. Invitations

  • Every member has a personal invite link and code. Someone joins through your invitation by signing up through your link, or by entering your code within 30 days of creating their account. An account can have only one inviter, and you cannot invite yourself.
  • An invited person qualifies once they have linked Discord and Steam and rated at least 10 games. The invitation also has to pass automated checks against fake accounts: the account is at least 7 days old, its ratings are spread over at least 3 days, and the accounts you invited do not sign in from the same address. Until then it is shown as waiting, with the reason.
  • For every three qualifying invitations you receive Moymo MAX for life, provided you meet the Moymo+ conditions at that moment; if you do not, the invitations wait until you do.
  • There are no cash rewards. We may change or end the programme with advance notice; rewards already granted stay.
  • As an inviter you see some information about the people you invited, as described in the Privacy notice, and they are told so.

12. Giveaways

  • Studios can run giveaways of game keys and other prizes on Moymo. The organiser of each giveaway is the studio named on it, with its contact details; the organiser is responsible for the prize and for the giveaway's rules. Moymo provides the platform and is not the organiser.
  • Entry is free and never requires a purchase. You need a Moymo account; any further eligibility conditions are set out in the giveaway's rules, which apply alongside these Terms.
  • Winners are drawn at random by Moymo when the giveaway closes. A prize code is shown to the winner in Moymo; other prizes are delivered by the organiser.
  • Entering with several accounts, or with accounts created for the purpose, is not allowed and leads to disqualification.

13. Terms for studios

This section applies to developers and publishers who use Moymo for their business: studio pages, game pages, updates and giveaways. For them it is, together with the rest of these Terms, the terms and conditions under Regulation (EU) 2019/1150 on platform-to-business relations. A studio accepts it when it applies to the creator programme.

  • Joining: the creator programme is free. A studio applies, staff check that it is who it says it is and that it represents the games it claims, and decide. A refusal comes with its reason.
  • What studios can do: edit their game pages, publish updates, run giveaways, invite team members by e-mail and manage their roles, and talk to Moymo staff in the studio chat.
  • Content: studios give us the same licence as members (see Your content) for logos, artwork, screenshots and texts, and confirm that they hold the rights to them, including trademarks. Game pages are part of the catalogue: after a studio leaves, its texts may be replaced by texts from other sources.
  • Restriction and suspension: we may restrict or suspend a studio, or some of its features or games, if it breaks these Terms or the law, publishes misleading information, does not deliver giveaway prizes, impersonates someone, or puts members at risk. We give a statement of reasons before or when the measure takes effect, and the studio can respond in the studio chat.
  • Ending the relationship: we give at least 30 days' notice, with reasons, before we end a studio's participation entirely, unless the law requires us to act sooner, the studio has seriously or repeatedly breached these Terms, or there is a security risk. A studio can leave at any time.
  • Ranking: studio games are ordered by the same main parameters as every other game (see How Moymo orders games). Studios cannot pay for ranking, and Moymo has no games of its own to favour.
  • Data: studios see aggregate statistics for their games, public reviews, their own content and, for their giveaways, the number of entries and the winners' usernames, display names and avatars. They do not see members' e-mail addresses or private data. Moymo has access to everything studios publish or send through the panel.
  • Complaints: a studio can raise any complaint about these terms or our decisions in the studio chat or at [DOPLNIT: kontaktní e-mail provozovatele]; a person answers.
  • Changes: we announce changes to this section to studios at least 15 days before they take effect, longer where a change requires larger adjustments. A studio that does not agree may end its participation before then.
  • Studios are free to offer their games anywhere else, on any terms.

14. YouTube and other services

Some features - showing a member's YouTube channel and videos - use YouTube API Services. By using those features you agree to be bound by the YouTube Terms of Service: https://www.youtube.com/t/terms. Google's privacy policy: https://policies.google.com/privacy.

When you link another service or load an embedded player, that service's own terms also apply to your use of it. Prices and deals come from IsThereAnyDeal and CheapShark and are for information only; the store's own price is what counts. Links to shops may go through those services, which may earn a commission if you buy; Moymo earns nothing from them.

15. Availability and changes to the service

We work to keep Moymo running and secure, but cannot promise it will always be available or free of errors. We may change, add or remove features; if a change significantly limits what you use, we will tell you in advance.

We may end the service entirely with at least 30 days' notice, and you will be able to download your data before it ends.

16. Liability

We are liable for damage as the law provides. We do not limit liability for damage caused intentionally or through gross negligence, for harm to life or health, or wherever the law does not allow it.

Moymo hosts content published by members and studios and is not responsible for it unless we knew it was illegal and did not act (Digital Services Act Art. 6). Game information, ratings and prices come partly from other sources and may contain errors.

If you are a consumer, nothing in these Terms limits the rights mandatory law gives you.

17. Ending the contract

You can end the contract at any time by deleting your account.

We can end it for a serious or repeated breach of these Terms, with a statement of reasons that you can appeal, or by ending the service as described above.

18. Changes to these Terms

We may change these Terms for good reasons: changes in the law, new or changed features, security, or to make them clearer. We will tell you at least 30 days before a change takes effect, by e-mail and in Moymo, and the new version will be shown with its date and version number.

Changes required by law or by an authority, or needed to deal with an unforeseen security threat, may take effect sooner.

When a new version takes effect, you will be asked to accept it the next time you use Moymo. If you do not agree, you can delete your account, free of charge, at any time before or after the change.

19. Governing law and disputes

These Terms are governed by Czech law. If you are a consumer living in another EU country, you also keep the protection of the mandatory rules of that country, and you can bring proceedings in its courts.

If you are a consumer, you can also turn to the out-of-court consumer dispute resolution body: the Czech Trade Inspection Authority (Česká obchodní inspekce), Štěpánská 567/15, 120 00 Praha 2, https://adr.coi.cz, https://www.coi.cz. The EU online dispute resolution platform has been discontinued (Regulation (EU) 2024/3228).

Disputes about moderation can also go through the routes in Appeals.

20. Language versions and records

These Terms are published in Czech and English, and both versions are equally binding.

We record which version you accepted and when. Every version stays available: the current one on this page, earlier ones on request.

If a provision turns out to be invalid, the rest remains in effect.
